Tokyo Metropolitan Government Enacts Anti-Social Forces Restriction Ordinance
The Tokyo Metropolitan Government enacted the Anti-Social Forces Restriction Ordinance on October 1st, being one of the last local governments to implement such restriction, thus completing the nation-wide movement to discourage businesses from having connections and entering into transactions with anti-social forces such as boryokudan, etc.
The Government is recommending businesses to adopt several clauses in its contracts, for example, a clause requiring the counterparty to warrant that it is not an anti-social force and another clause allowing termination of the contract in the case of breach.
The Tokyo Ordinance also stipulates an obligation for businesses to confirm that the counterparty is not an anti-social force. Failure to meet this obligation may be met with penalties such as fines and disclosure of the names of business entities that have failed to fulfill this obligation.
